KEPSA participated in the official rollout of the Public Participation Legislative Process breakfast meeting held on Wednesday, September 18, 2024, at the Kenya School of Government, Lower Kabete, Nairobi organized by the Office of the Attorney General and Department of Justice. The focus of the meeting was the conceptualization and overview of the legislative proposals on the draft Public Participation Bill, 2024.
Hon. Shadrack J. Mose, the Solicitor General, in his remarks, emphasized the significance of public participation and engagement in reinforcing and legitimizing legislation, which fosters good governance and a foundation for true democracy in Kenya.
Also in attendance was Ms. Aurelia Chepkirui Rono, Principal Secretary of the State Department of Parliamentary Affairs, who acknowledged the efforts to develop a 'standalone' public participation legislative framework aimed at addressing past challenges such as inefficient time utilization and insufficient financial resources in public participation. She underscored the reliance on the 2,182 reported judicial decisions on public participation cases, as of February 2024, and pointed out the duplicity in practice caused by fragmented legislation. The Principal Secretary stressed the need for a unified law that aligns with existing laws, including the Constitution of Kenya, 2010.
KEPSA recognizes the crucial importance of the Public Participation Bill, 2024, and recommends the creation of a law that is self-executing, inclusive, and transparent, reflecting the spirit of public engagement rather than merely fulfilling a constitutional obligation. Further recommendations focus on providing clarity in the Bill regarding the public participation process, timelines, inclusivity framework, and the development of guiding and implementation frameworks.

Stakeholders were invited to provide any further feedback and suggestions to enrich the final draft of the Bill to ensure upon its enactment it would meet the needs of the business community and align with Kenya’s economic goals.
