KEPSA Security Sector Board, led by the Chair Ms Annette Kimitei, met with the Data Commissioner Ms Immaculate Kassait on 6th December 2022 at the KEPSA offices. The agenda of the meeting was to explore potential areas of collaboration as well as appraise the Data Commissioner on some of the challenges in the security sector.
In her opening remarks, Ms Annette Kimitei appreciated the Office of the Data Protection Commissioner (ODPC) for continuous efforts in ensuring that there is clarity in matters relating to data. She noted that the security sector is one of the largest employers in Kenya and yet the riskiest. Ms Kimitei went on to say that the Private Security Regulations Act no 13 of 2016 states that Private Security service providers have the power to record and temporarily withhold identification documents which she noted is confusing the industry players, especially with regard to the Data protection regulations.
In her response, Ms Kassait noted that the ODPC is aware of the challenges and concerns facing the security sector in terms of data collection. She went ahead to inform the meeting that they are setting up a task force that will help come up with a guidance note specifically for the security sector.
Data Protection Commissioner also noted that the goal of the ODPC is not to punish individuals but to ensure that there are proper guidelines to guide the sector and ensure that they comply. She concluded by saying that the ODPC acknowledges the Private Sector as an important partner in ensuring businesses comply and create awareness on matters of Data protection.
