KEPSA Lands, Physical planning, Housing, and Urban development sector board has begun a partnership with the ELC for capacity building and knowledge sharing on matters of land and built environment sector and real estate in general.
The meeting held on 2nd April 2024 at Milimani Law Courts with the registrar Hon. Lady Justice Rose Makungu acting as chair welcomed the partnership proposal to incorporate best practices, enhance the quality and efficiency of the court system and support institutions. This partnership aims to provide comprehensive capacity-building initiatives and foster knowledge sharing among judges in the Environment and Land Court (ELC).
Registrar Rose Makungu expressed her enthusiasm for this partnership, highlighting its potential to significantly benefit the judiciary and improve the quality of legal decisions in land-related cases. She emphasized the importance of equipping judges with specialized knowledge and skills, considering the intricate nature of land and built environment disputes.
Currently, the Environment and Land Court has 53 judges distributed across 40 courts in 40 counties, accompanied by 45 deputy registrars. Registrar Makungu revealed that the upcoming training programs would not only cater to judges but also extend to include researchers within the ELC sector. This comprehensive approach underscores the commitment to building a robust ecosystem of legal expertise and knowledge exchange.
The training curriculum is set to cover a wide array of topics essential to understanding and adjudicating land and built environment cases effectively. These include but are not limited to:
Land and Property Laws: In-depth analysis and interpretation of statutes governing land ownership, land use, and property rights.
Environmental Conservation and Management: Understanding the legal frameworks and principles guiding environmental protection and sustainable development.
Urban Planning and Development Regulations: Navigating the complexities of urban planning laws, zoning regulations, and development control mechanisms.
Case Studies and Precedents: Examining landmark judgments and precedent-setting cases in land and built environment law to enhance jurisprudential knowledge.
